1. You Contact Us (Before or After Signing): Ideally before you sign the Agreement of Purchase and Sale. We offer a free consultation to review the agreement before you commit. If already signed, contact us immediately so we have maximum lead time.

2. We Open Your File: We request your Agreement of Purchase and Sale, mortgage commitment letter (if applicable), and identification. Your file is assigned to Hassan Tahir directly.

3. Title Search & Due Diligence: Approximately 3–4 weeks before closing, we conduct a full title search through Teranet. We check for registered mortgages, liens, easements, work orders, and any other encumbrances that could affect your ownership. If issues are found, we address them with the seller’s lawyer before closing day.

4. Document Preparation & Review: We prepare the transfer deed, mortgage documents (if applicable), land transfer tax affidavit, statement of adjustments, and title insurance. We arrange a signing appointment in-person at our Burlington office or virtually via video call typically 1–3 business days before closing.

5. Closing Day: We receive your funds from your mortgage lender, wire the balance due to the seller’s lawyer, and register the transfer of title in your name through the Ontario land registry. Keys are released once funds are confirmed usually by 3:00 PM on closing day.

6. Post-Closing Reporting: Within 2–3 weeks of closing, we send you a comprehensive reporting package: your title deed, title insurance policy, statement of adjustments, and confirmation of all registrations. Your file is complete.

Frequently Asked Questions

Yes, it is a legal requirement. In Ontario, every residential real estate transaction must be closed by a licensed lawyer. There is no option to handle a property closing yourself or use a notary alone, as there is in some other provinces. Your lawyer registers the transfer of title through the Ontario land registration system (Teranet), handles all fund disbursements, secures title insurance, and provides independent legal protection for your interests throughout the transaction. For Burlington buyers, this is a non-negotiable step and choosing the right lawyer makes the entire experience dramatically smoother.

The OREA Agreement of Purchase and Sale (Form 100) is the standard legal contract used in Ontario real estate transactions. Prepared by the buyer’s real estate agent, it sets out the purchase price, closing date, deposit amount, conditions (such as financing approval and home inspection), included chattels and fixtures, and all other legally binding terms. Once both parties have signed and all conditions have been fulfilled or waived, the agreement becomes binding and can only be exited in very limited circumstances.
