As your full-service property lawyer in Burlington, Estofa Law handles every type of residential and commercial real estate transaction across Halton Region. Whether you need a home buying lawyer in Burlington or assistance with a complex title transfer, our team manages every legal detail so your closing is smooth and stress-free.

Home Purchase Closings

Buying a home in Burlington? We review your OREA Agreement of Purchase and Sale, conduct a full Teranet title search, prepare all closing documents, and register the transfer in your name. We work with freehold homes, condominiums, new construction, and estate sales across Burlington and Halton Region.

Property Sale Closings

Selling your Burlington home requires a lawyer to prepare the deed, discharge your existing mortgage, calculate the statement of adjustments, and transfer funds on closing day. Our experienced real estate closing lawyers in Burlington ensure your sale is completed on time with no last-minute complications.

Mortgage Refinancing

Refinancing your Burlington home? We prepare all lender documents, arrange the discharge of your existing mortgage, register the new charge on title, and advise you on any hidden penalties buried in your mortgage agreement. We work with A-lenders, B-lenders, and private mortgage lenders.

Title Transfer (Change of Ownership)

Need to transfer your Burlington property into a spouse’s name, add a family member to title, or restructure ownership following a relationship change? Our title transfer and change of ownership services cover all situations, and we advise upfront on any land transfer tax or capital gains implications.

Independent Legal Advice (ILA)

Many lenders require a borrower to obtain Independent Legal Advice before signing a mortgage or co-signing agreement. Our ILA lawyers in Burlington provide this service promptly, with same-day and next-day appointments often available to meet your lender’s closing timeline.

Purchase & Sale for Non-Residents

Foreign nationals and non-residents purchasing or selling Burlington real estate face additional obligations under the Foreign Buyers Ban, Non-Resident Speculation Tax (NRST), and CRA withholding rules. We guide non-resident buyers and sellers through every compliance step with care and precision.

Survivorship Application

When a joint property owner passes away, the surviving spouse or co-owner must apply to remove the deceased’s name from title through a survivorship application. We handle this process sensitively and efficiently, ensuring the title is updated properly in the Ontario land registry.

Matrimonial Home Designation

Ontario law gives both spouses equal rights to the matrimonial home regardless of who holds title. We advise on and prepare matrimonial home designations, providing legal certainty for families in Burlington purchasing or restructuring their primary residence.

Private Lending Services

Acting for private lenders and borrowers, we prepare and register private mortgages in Burlington, draft terms that protect both parties, and ensure all security is properly registered on title. Our private lending lawyers are experienced in both first and second mortgage positions.

Land Transfer Tax in Burlington — A Major Advantage Over Toronto

One of the most significant financial advantages of buying real estate in Burlington rather than Toronto is the land transfer tax. Burlington, like most Ontario cities outside Toronto, charges only the Provincial Land Transfer Tax (PLTT) there is no additional municipal land transfer tax.

Purchase Price

Provincial LTT (Burlington)

First-Time Buyer After Rebate

$500,000

$6,475

Estofa Law helped us out with our mortgage. Between Hassan and Hafiz they were always very prompt with communication, helpful and easy going. We had several phone calls and an online meeting with Hassan who explained everything to us clearly and answered all of our questions. This was our first house purchase so everything had a steep learning curve and overall, it's a very nerve wracking process. Fortunately the lawyer portion of it wasn't too bad thanks to Estofa Law!

How the Real Estate Closing Process Works in Burlington

Many clients, especially first-time buyers are unsure of what their real estate closing lawyer actually does between signing the agreement and getting the keys. Here is a clear, step-by-step overview of how our process works for a standard Burlington home purchase:

1. You Contact Us (Before or After Signing): Ideally before you sign the Agreement of Purchase and Sale. We offer a free consultation to review the agreement before you commit. If already signed, contact us immediately so we have maximum lead time.

2. We Open Your File: We request your Agreement of Purchase and Sale, mortgage commitment letter (if applicable), and identification. Your file is assigned to Hassan Tahir directly.

3. Title Search & Due Diligence: Approximately 3–4 weeks before closing, we conduct a full title search through Teranet. We check for registered mortgages, liens, easements, work orders, and any other encumbrances that could affect your ownership. If issues are found, we address them with the seller’s lawyer before closing day.

4. Document Preparation & Review: We prepare the transfer deed, mortgage documents (if applicable), land transfer tax affidavit, statement of adjustments, and title insurance. We arrange a signing appointment in-person at our Burlington office or virtually via video call typically 1–3 business days before closing.

5. Closing Day: We receive your funds from your mortgage lender, wire the balance due to the seller’s lawyer, and register the transfer of title in your name through the Ontario land registry. Keys are released once funds are confirmed usually by 3:00 PM on closing day.

6. Post-Closing Reporting: Within 2–3 weeks of closing, we send you a comprehensive reporting package: your title deed, title insurance policy, statement of adjustments, and confirmation of all registrations. Your file is complete.

Frequently Asked Questions

Yes, it is a legal requirement. In Ontario, every residential real estate transaction must be closed by a licensed lawyer. There is no option to handle a property closing yourself or use a notary alone, as there is in some other provinces. Your lawyer registers the transfer of title through the Ontario land registration system (Teranet), handles all fund disbursements, secures title insurance, and provides independent legal protection for your interests throughout the transaction. For Burlington buyers, this is a non-negotiable step and choosing the right lawyer makes the entire experience dramatically smoother.

Your Burlington real estate lawyer performs all of the legal work behind your closing, including: reviewing your OREA Agreement of Purchase and Sale for legal risks; conducting a full title search to confirm the property is free of liens, encumbrances, and outstanding work orders; preparing all transfer and mortgage documents; communicating with the opposing lawyer and your mortgage lender; calculating your statement of adjustments (property tax and utility adjustments between buyer and seller); registering the title transfer with the Province of Ontario; disbursing funds on closing day; and sending you a complete reporting package after closing. For condo purchases, we also review the status certificate from the condo corporation.

The closing period from the date of signing the Agreement to the actual closing date is negotiated between buyer and seller and is typically 30 to 90 days for resale transactions. New construction closings can have much longer timelines of 6 months to several years. The legal work itself, from the time your file is opened to closing day, takes approximately 3 to 4 weeks. On the actual closing day, the title transfer is registered and keys are released usually between 12:00 PM and 4:00 PM, depending on when funds clear from the mortgage lender.

A leagl expert’s help is the safe path in a real estate sale or purchase process, as they check contracts and review titles. Our team spots issues early and protects your real estate.

At Estofa Law, legal fees for a standard Burlington home purchase start at $999 + HST, property sale fees start at $849 + HST, and mortgage refinancing fees start at $699 + HST. These are flat-rate fees not hourly estimates. In addition, you will pay disbursements (government registration fees, title insurance, Teranet search fees, and couriers), which we estimate at $700–$1,200 for most Burlington transactions. Your full out-of-pocket legal cost for a typical Burlington home purchase is approximately $1,800–$2,400 all-in. We provide a complete written quote at no charge before you commit.

Yes. A lawyer reviews your purchase contract and review the title to make sure it is clear of any liens. We also offer help with mortgage and get you the best terms.

Our lawyers check for liens or claims during title search checks. On the other hand, the title transfer process means change of ownership (which we also handle).

Yes. We help homeowners and landlords, as well as developers and business owners. We guide you fully whether you buy a condo or manage a building.

The ideal time to contact a Burlington real estate lawyer is before you sign the Agreement of Purchase and Sale. A lawyer review before signing can catch problematic conditions, missing clauses, or unrealistic closing timelines before you are legally bound. However, if you have already signed, contact us immediately as long as conditions have not been waived, there is still time to address concerns. For sellers, we recommend contacting us as soon as you accept an offer, or even during the listing process if you are unsure about the legal implications of your deal. Early contact always leads to a better outcome.

Generally no, and for good reason. Ontario’s Rules of Professional Conduct restrict lawyers from representing parties with conflicting interests in the same transaction. A buyer and seller have opposing financial interests every dollar negotiated benefits one party at the expense of the other. To avoid this conflict and protect both parties’ rights, each side should have their own independent legal representation. There are very narrow exceptions for transactions between closely related family members with full informed consent, but these are uncommon and carry risk. At Estofa Law, we always act exclusively in our client’s best interests.

The OREA Agreement of Purchase and Sale (Form 100) is the standard legal contract used in Ontario real estate transactions. Prepared by the buyer’s real estate agent, it sets out the purchase price, closing date, deposit amount, conditions (such as financing approval and home inspection), included chattels and fixtures, and all other legally binding terms. Once both parties have signed and all conditions have been fulfilled or waived, the agreement becomes binding and can only be exited in very limited circumstances. Your real estate lawyer reviews the Agreement on your behalf, identifies any legal risks or missing protections, and works within its terms to prepare your closing. In Burlington, we review dozens of these agreements every month and know exactly what to look for.
